¶1Heard learned counsel for petitioner and learned Standing Counsel for the State.

¶2Present petition has been filed by the petitioner for mandamus commanding the opposite parties not to make any further construction of road over the petitioner's land without following the due process of acquisition and requisition over his land gata no.929, area measuring 0.0790 Hectare and 944, area measuring 0.0380 Hectare situated in Village Chandan Ka Purva, Revenue Village-Mijhuti, Pargana-Isauli, Tehsil-Sadar now Baldirai District Sultanpur.

¶3After arguing at some length, learned counsel for petitioner submits that grievance of petitioner would be sufficiently met in case he is permitted to move an appropriate application under Section 24 of U.P. Revenue Code, 2006 and the same may be decided expeditiously.

¶4In case petitioner moves such an application for demarcation, the authority concerned shall consider and decide the same, in accordance with law, after hearing all the parties concerned, as expeditiously as possible, say within a period of six weeks from the date the application along with a certified copy of this order is filed.
