Heard learned counsel for the petitioner and the learned Standing Counsel. Learned counsel for the petitioner submits that the application filed by the petitioner under Order 39, Rule 2-A C.P.C. in Regular Civil Appeal No.111 of 2013, is pending in the Court of Special Judge (P.C.) Act, (Court No.09), Lucknow, but the said Court is vacant at present, therefore, the said application is not being decided. Learned counsel for the petitioner is permitted to move an appropriate application before the District Judge, Lucknow for transfer of the said case before a regular Court. In case such an application is filed by the petitioner within a period of one week from today, the District Judge, Lucknow shall pass appropriate order within one week from the date of filing of the said application. The regular Court concerned shall take up the matter under Order 39, Rule 2-A C.P.C. expeditiously and pass appropriate orders on the same after hearing all the parties concerned.
