Judgment

Court No. - 3 Case :- WRIT - C No. - 9327 of 2023 Petitioner :- Harendra Nigam Respondent :- State Of U.P. Thru. Prin. Secy. Revenue Lko. And 3 Others Counsel for Petitioner :- Avdhesh Shukla Counsel for Respondent :- C.S.C.,Sanjeev Singh Hon'ble Vivek Chaudhary,J. Hon'ble Manish Kumar,J. Power filed by Sri Abhineet Jaiswal, Advocate for respondent no.2, is taken on record. Heard learned counsel for the parties. Petitioner has approached this Court challenging the notification dated 23.07.2002 issued under Section 4(1) of the 1894 Act of Land Acquisition read with Section 17(1) of the Act. It is surprising that the notification dated 26.2.2023, under Section 6, read with Section Section 17(1) of the Act, issued on

26.2.2023 is not challenged in the present petition. Admittedly, the award was issued in the year 2010 and the possession was also taken in the year 2018. As per learned counsel for the respondents, the possession was taken on

09.05.2005. Be that as it may, the petition is highly belated. Even if we take it from the date that the possession was taken, as per the petitioner, in the year 2018, this Court is not inclined to interfere in the matter. The writ petition is dismissed.
