This petition has been filed for a direction to the opposite party no.1/Debt Recovery Tribunal,Lucknow Bench, Lucknow to fix an earlier date for hearing in Securitization Application No.15 of 2022(M/s PPM Infrazone Pvt. Ltd. and others versus Union Bank of India). Further prayer has been made for direction to expeditiously decide the said Securitization Application. So far as the prayer no.1 is concerned, this petition has rendered infructuous because this petition was filed when 01.09.2023 was fixed by means of the order dated 08.08.2023 and this petition was filed on 26.08.2023. So far as the prayer no.2 is concerned, the petitioner has an alternative and statutory remedy before the Debt Recovery Appellate Tribunal under Section 17(6) of the Recovery of Debts and Bankruptcy Act,1993, which may be availed by the petitioner. Even otherwise this petition itself is not maintainable because the petitioner has not impleaded the applicant no.2 in the Securitization Application No.15 of 2022, in this petition.
