¶3The aforesaid case has been registered on the basis of an F.I.R. lodged on 10.11.2020 against two persons, including the applicant, stating that the informant had paid some money to R. Sons Associates for purchasing a plot of land in the name of his sons, however, neither the land was transferred nor was the informant's money refunded to him.

¶6The learned A.G.A. has opposed the prayer for bail but he could not dispute the aforesaid aspects of the matter.

¶7Having considered the aforesaid facts and circumstances of the case and keeping in view the fact that grievance of the informant is regarding non execution of the sale-deed or non refund of money paid for purchase of immovable property and it appears that no agreement was executed regarding sale of immovable property; that the applicant has already been granted bail in 58 other cases of similar nature and yet he is languishing in jail since 16.08.2020 and without making any observation, which may affect the merits of the case, I am of the view that the aforesaid facts are sufficient for making out a case for enlargement of the applicant on bail in the aforesaid crime.
