Submission of learned counsel for the petitioner is that the petitioner has filed Regular Suit No.232 of 2022 for specific performance and prays for a direction for disposal of the said suit which can not be directed by this Court, at this stage, as the suit is of the year 2022 and when there are many old cases pending before the court and also it appears from the order sheet that the defendant, after appearing, has moved an application for recall of the order proceeded ex-parte, which is pending consideration. At this stage, learned counsel for the petitioner submits that this petition may be dismissed as not pressed at this stage with liberty to approach the concerned court.
