Judgment
Court No. - 6 Case :- MATTERS UNDER ARTICLE 227 No. - 5488 of 2023 Petitioner :- M/S Bhoje Power Control System, Thru. Authorized Signatory Lokesh Chauhan And 2 Others Respondent :- Debts Recovery Tribunal , Lko. And Another Counsel for Petitioner :- Mujtaba Kamal Sherwani Counsel for Respondent :- Anoop Kumar Misra Hon'ble Rajnish Kumar,J. Heard Sri Mujtaba Kamal Sherwani learned counsel for the petitioners and Sri Anoop Kumar Misra learned counsel for the respondent no.2. Learned counsel for the petitioners submits that the petitioners have filed S.A. no.799 of 2023 (M/s Bhoje Power Control System and others vs Punjab National Bank) along with an application for interim relief on 06.09.2023. When the application was taken up for hearing on 10.10.2023, the respondent bank gave a statement that no bid has been done, therefore, IR has rendered infructuous but subsequently the bank has given application for correction of the order on the ground that the sale has been made. He makes an innocuous prayer for disposal of the application for interim relief within some stipulate period. To which, there is no objection by the learned counsel for the opposite party no.2 and he fairly conceded that a direction may be issued for disposal of application for interim relief within a short time bound period. Without entering into merit of the case, the petition be disposed of with a direction to the Debt Recovery Tribunal, Lucknow, to consider and dispose of the interim relief application filed by the petitioners along with S.A no.799 of 2023 (M/s Bhoje Power Control System and others vs Punjab National Bank) expeditiously within a period of four weeks from the date of production of a certified copy of this order.
