Petitioner has approached this Court challenging the impugned order dated 12.01.2023 whereby certain dues has been raised against the petitioner by the respondent no. 5-Executive Engineer, Zone-3, Lucknow Development Authority, Vipin Khand, Gomti Nagar, Lucknow. Learned counsel for the petitioner submits that the opportunity of hearing was not given to the petitioner before passing the impugned order. Shri Rajesh Kumar, learned counsel for the Lucknow Development Authority was granted time to complete his instructions and on instructions he states that the order has been passed without any opportunity of hearing. In view thereof, the order dated 12.01.2023 and consequential orders thereof are hereby set aside. It shall be open for the respondent no. 3 to pass afresh order, if he so desires after giving property opportunity of hearing to the petitioner. Writ petition is allowed.
