Petitioner has approached this Court challenging the notice dated 03.03.2023 whereby he has been asked to remove his unauthorized construction. Sole submission of learned counsel for the petitioner is that no opportunity of hearing was given to the petitioner before passing the said notice. Learned counsel for the Nagar Nigam states that the notice in question is only a show cause notice and the Nagar Nigam shall provide the documents including the report on the basis of which notice is given to the petitioner, within a period of one week from today. Petitioner may submit his reply within a period of two weeks, thereafter. Nagar Nigam shall pass final order in accordance with law after giving opportunity of hearing to the learned counsel for the petitioner within a period of three weeks, thereafter. Any action with regard to petitioner shall be subject to the final order to be passed by the Nagar Nigam.
