This petition has been filed for a direction for removal of encroachment from Gata No.623 situated at Village Prahladpur, Pargana and Tehsil Laharpur, District Sitapur, which is recorded as Rasta in the revenue records. Learned Standing Counsel on the basis of instructions submits that encroachers have made encroachment on the P.W.D. road, which has no concern with the Gaon Sabha and the action can be taken by the Public Works Department. Accordingly by means of the letter dated 28.10.2023, it has been informed to the Public Works Department for taking appropriate action. Copy of instructions filed by learned Standing Counsel is taken on record. In view of above, this petition without impleading the Public Works Department is not maintainable. However, this petition is disposed of in terms of the statement of learned Standing Counsel with liberty to the petitioner to approach the Public Works Department for taking appropriate action in accordance with law.
