Judgment

Court No. - 6 Case :- MATTERS UNDER ARTICLE 227 No. - 5082 of 2023 Petitioner :- Kiran Tiwari Respondent :- Additional Principal Judge-6 Family Court Lko. And Another Counsel for Petitioner :- Suyash Bajpai,Gaurav Singh Hon'ble Rajnish Kumar,J. Sri K.M.Tripathi, Advocate holding brief of Sri Suyash Bajpai, learned counsel for the petitioner submits that the petitioner has filed a Regular Suit No.4297 of 2022 under Section 13(1)(1A) of the Hindu Marriage Act 1955 and prays for a direction for disposal of the suit within some short stipulated period on the ground that the case is old one and is being got adjourned by the respondent, whereas there is urgency in the matter. Perusal of the order sheet placed on record by the petitioner does not indicate that the case is being got adjourned by the respondent. The case is also of the year 2022 and no urgency has been shown by the petitioner. Even otherwise perusal of the order sheet indicates that the matter was referred to the mediation centre. On a query being put, learned counsel for the petitioner submits that the mediation has failed. However, he fairly submits that report has still not been sent to the concerned court. In view of above, this Court is not inclined to issue any direction for disposal of case of the year 2022 merely because the petitioner wants disposal of the suit at an early date. So far as the urgency is concerned, no urgency has been shown by the petitioner. However, it is always open for the parties to move appropriate application showing urgency, which may be considered by the concerned court in accordance with law. Dismissed accordingly.
