¶1Heard Sri Sudhakar Prakash, learned counsel for the applicant, Sri Jayant Singh Tomar, learned A.G.A. for the State and perused the records.

¶2The instant application has been filed seeking release of the applicant on bail in Case Crime No. 270 of 2023, under Sections 3/5/8 of U.P. Prevention of Cow Slaughter Act, registered at Police Station Talgaon, District Sitapur.

¶3The aforesaid case has been registered on the basis of an F.I.R. lodged by a Sub Inspector of Police on 28.08.2023 against four persons, including the applicant stating that the informant received information from a mukhbir at 02.15 hrs. on the basis whereof the accused persons were intercepted. The applicant and co-accused Kamlesh Pasi were arrested and other two persons escaped. In a sac lying nearby 40 kg. flesh of cow progeny was kept.

¶6Having considered the aforesaid facts and circumstances of the case and keeping in view the fact that there are no independent persons of the alleged recovery; that the besides the flesh of cow progeny no other remains of cow progenies have been recovered; that the applicant has no previous criminal history and he is languishing in jail since 26.08.2023 and without making any observation, which may affect the merits of the case, I am of the view that the aforesaid facts are sufficient for making out a case for enlargement of the applicant on bail in the aforesaid crime.

¶7Accordingly, this bail application stands allowed.
