¶1Heard learned counsel for the parties.

¶2The grievance of the petitioner is that certain amount deposited by the members of the Society has not been returned by the Society.

¶3Learned Standing Counsel raises a preliminary objection that the petitioner has sufficient remedies under the Co-operative Societies Act, 1965 or to file a suit.

¶4Learned counsel for petitioner prays to withdraw the present petition with liberty to file appropriate application under Section 65 of U.P. Co-operative Societies Act, 1965 before Registrar, Co-operative Societies. In case such an application is filed, Registrar, Co-operative Societies, after hearing all the parties, take the matter to a logical conclusion within a period of four weeks.
