Court No. - 1 Case :- PUBLIC INTEREST LITIGATION (PIL) No. - 1007 of 2023 Petitioner :- Girindra Pal And Others Respondent :- State Of U.P. Thru. Prin. Secy. Energy U.P. Govt. Lko. And Others Counsel for Petitioner :- Amit Kumar,Avdhesh Kumar Singh Yadav,Mahesh Singh Yadav,Prabhat Kumar Saxena Counsel for Respondent :- C.S.C.,Aprajita Bansal Hon'ble Attau Rahman Masoodi,J. Hon'ble Om Prakash Shukla,J.
¶1Heard learned Counsel for the petitioners and Ms. Aprajita Bansal, learned Counsel for for respondents no.2 to 5 and learned State Counsel for respondent no.1.
¶2At the very outset, Ms. Aprajita Bansal, learned Counsel for respondents no.2 to 5 has raised a preliminary objection as to the maintainability of the present petition filed in public interest. It is submitted that under a revamping scheme, the transmission of electricity is secured by laying proper insulation lines in order to cater larger need of electricity to the area in question. It is also informed that the revamping scheme is aimed at to secure the existing distribution through low tension lines. Thus, the present writ petition filed in public interest is wholly baseless and unfounded.
¶3Learned Counsel for the petitioners has placed no material on record to substantiate the grievance raised.
¶4In absence of any evidence or material making out a case, the present PIL being bereft of any merit is, accordingly, dismissed. (Om Prakash Shukla, J.) (Attau Rahman Masoodi, J.) Order Date :- 31.10.2023 Anand Sri./- High Court of Judicature at Allahabad, Lucknow Bench
