¶1Heard learned counsel for petitioners and Sri S.B. Pandey, learned Senior Advocate and Deputy Solicitor General of India assisted by Sri Ambrish Rai, appearing for all the respondents.

¶2Petitioners have approached this Court challenging the order dated 16.9.2023 whereby petitioners have been blacklisted without giving any opportunity of hearing to them for an indefinite period.

¶3A perusal of impugned order itself shows that the same is passed without giving any opportunity of hearing to the petitioners and also no period is provided in the same. Thus, the impugned order cannot be said to be valid in the eyes of law.

¶4In view thereof, the impugned order dated 16.9.2023 is set aside with liberty to the respondents, if they so desire, to pass a fresh order in accordance with law after giving an opportunity of hearing to the petitioners.
