Mishra, learned counsel for the petitioner submits that the petitioner has filed an application for recall of the order dated 12.07.2023, by means of which the application for interim injunction filed by the petitioner in Regular Suit No.1621 of 2021;Guddu Ansari versus Laxmi Narayan and others has been dismissed for non prosecution by the Civil Judge(S.D.), Lucknow. The application was filed on 15.07.2022, on which the objections were invited and all the parties are represented but till date the same has not been disposed of, whereas there is urgency in the matter. Perusal of the order sheet indicates that on 15.07.2023, objections were invited and on 23.08.2023 fresh steps were directed to be taken and on 10.10.2023,notice has been deemed sufficient and as a last opportunity, time has been granted fixing

08.11.2023. Therefore it cannot be said that the case is being adjourned without any reason. Therefore at this stage, this Court is not inclined to issue any direction for disposal of the application. However, in case of any urgency, application for expeditious disposal can always be filed showing urgency by any party and considered by the concerned court. Dismissed accordingly.
