Judgment

Court No. - 10 Case :- CRIMINAL MISC. WRIT PETITION No. - 8375 of 2023 Petitioner :- Ramraji And Others Respondent :- State Of U.P. Thru. Prin. Secy. Home And Others Counsel for Petitioner :- Vinod Kumar Tripathi Counsel for Respondent :- G.A. Hon'ble Mrs. Sangeeta Chandra,J. Hon'ble Narendra Kumar Johari,J. Heard learned counsel for the petitioners and learned A.G.A. for the State. This petition has been filed with the following main prayer:- "issue a writ, order or direction in the nature of Certiorari hereby quashing the Impugned First Information Report dated 10.7.2023 registered by the Opp. Party No.4 at Case Crime No.0196/2023 in Police Station-Kotwali Nagar, District-Bahraich under section 419, 420, 467, 468, 471 I.P.C. so far it relates with the petitioners as contained in Annexure No.5 to this Writ Petition." It has been submitted by learned counsel for the petitioners that the petitioners are completely innocent and have been falsely implicated. Most of them are ladies and have no concern at all with the alleged forging of any order passed by the Board of Revenue. This Court has gone through the contents of the F.I.R. and finds that the orders of the Board of Revenue were forged and benefit of such orders was taken by the petitioners. The petitioners being the beneficiary, it cannot be said that they have no role to play. After having examined the submissions advanced by learned counsel for the parties and perused the impugned F.I.R., we are of the opinion that the impugned F.I.R. discloses cognizable offence by the petitioners, hence, no interference is called for by this Court in its extraordinary power under Article 226 of the Constitution of India for quashing of the F.I.R. or for grant of any interim relief to the petitioners and accordingly, the present writ petition is dismissed.
