¶1Heard learned counsel for the applicant and learned AGA for the State.

¶2Learned counsel for the applicant submitted that the applicant was implicated in Case Crime No.897 of 2020 under Section 302, 201 IPC, Police Station-PGI, District-Lucknow and he is in jail since 11.02.2023. As the father of the applicant was under treatment due to ailment and he died on 20.10.2023 and Terahvi is scheduled on 1st November, 2023, therefore, he may be allowed to join the Terahvi ceremony of his father in the police custody.

¶3Learned AGA on the basis of the instructions received from SHO-PGI, Lucknow on whats-app informed that the father of the applicant died on 20.10.2023 and Terahvi ceremony is scheduled in the Village-Kaurauna, Police Station-Sandana, District-Sitapur tomorrow.

¶4Considering the submissions of learned counsel for the parties and going through the contents of the petition as well as the written instructions placed by Shri Rao Narendra, learned AGA duly signed by Sub Inspector-Vikas Kumar Tiwari, Police Station-PGI as well as telephonic confirmation from the SHO, Police Station-Sandana, District-Sitapur that on 1st November, 2023, Terahvi ceremony of the father of the applicant is scheduled, therefore, the Commissioner of Police as well as Senior Superintendent, District Jail, Lucknow and S.P., Sitapur are directed to facilitate the proper escort and transportation vehicle to the applicant to attend the Terahvi ceremony of his father at early morning at village-Kaurauna, Police Station-Sandana, District-Sitapur at early morning and again he will be produced at the jail by 5:00 pm.

¶5Shri Rao Narendra, Learned AGA will ensure the intimation and compliance of the direction of this Court.
