¶1Heard learned counsel for the applicant, Ms. Nusrat Jahan, learned AGA and perused record.

¶2Present application has been filed with prayer to quash the chargesheet No.2 of 2023 dated 7.4.2023 and entire criminal proceeding as well as summoning order dated 2.9.2023 in Crl. Case No.27924 of 2023 (State.Vs. Mahesh Kumar and others.) case crime No.269 of 2022 under Section 419, 420, 467, 468, 504, 506, 34, 447 IPC PS Motipur district Bahraich in the Court of Civil Judge (SC/ST)/FTC, Bahraich with further prayer to stay the proceedings thereof.

¶3After arguing at some length learned counsel for the applicant does not want to press this case on merit and he has submitted that the applicant may be permitted to surrender before the Court below and apply for bail. Learned AGA has no objection to this prayer of the learned counsel for the applicant.

¶4In view of aforesaid, the applicant is directed to appear before the Court below within three weeks and apply for bail. In case, the applicant moved his bail application, the same will be considered and decided in accordance with law expeditiously.
