¶1Heard learned counsel for petitioner, Sri Pankaj Gupta, learned counsel for respondent no.5 and learned Standing Counsel for State.

¶2Petitioner has approached this Court challenging the order dated 04.03.2023 passed by respondent no.4 under Section 67 of U.P. Revenue Code. By the said order, the eviction proceedings are decided ex-parte against the petitioner.

¶3Learned Standing Counsel states that petitioner has already filed a recall/restoration application against the order dated

04.03.2023 which is fixed for hearing on 08.11.2023.

¶4It is expected that respondent no.4 Assistant Collector/Tehsildar, Nanpara, District Bahraich shall hear the restoration application on the next date fixed and decide the same after hearing all parties concerned, in accordance with law within a period of three weeks thereafter. In case petitioner so desires, he may file stay application which shall also be considered and decided expeditiously.
