Shri Pal Singh Yadav, learned counsel for the petitioner submits that the petitioner has filed a Regular Suit No.324 of 2021; Smt.Pooja Gupta Versus Ramesh Gupta under Section 13 of the Hindu Marriage Act, whereas the same has been mentioned as Case No.3424 of 2021 in the application, but learned counsel for the petitioner submits that the case number is 324 of 2021 and the respondent no.2 has filed a Case No.3735 of 2019 under Section 9 of the Hindu Marriage Act, which are pending in the court of Additional Principal Judge Court No.10, Lucknow therefore the petitioner has moved an application for clubbing both the case and deciding together on 15.05.2023 in Regular Suit No.324 of 2021, but till date the same has not been disposed of. The respondent no.1 is the court concerned. Considering the nature of order proposed to be passed issuance of notice to respondent no.2 is dispensed with. Without entering into the merit of the case the petition is disposed of with direction to the concerned court to consider and dispose of the aforesaid application of the petitioner expeditiously and preferably within a period of four weeks, from the date of filing of certified copy of this order before the concerned court, in accordance with law and without granting unnecessary adjournment to either of the parties. . ...........................................(Rajnish Kumar,J.)
