¶1Learned Standing Counsel raises a preliminary objection that petitioner has an alternative remedy of revision to challenge the impugned order passed by the Chairman of the development authority before the State Government under Section 41(3) of the Regulation of Building Operation Act, 1958.

¶2In case such a revision is filed by petitioner along with stay application, the revisional authority shall consider and decide the stay application of petitioner, expeditiously in accordance with law.

¶3It is made clear that this Court has not gone into the merits of the case and all questions are left open to be considered and decided by the authority concerned in accordance with law.
