Lko And Another Counsel for Revisionist :- Adhyatm Singh,Kuldeep Singh,Nandini Pandey,Seema Dubey (Tiwari) Counsel for Opposite Party :- G.A. Hon'ble Shamim Ahmed,J. Heard learned counsel for the revisionist as well as learned A.G.A. for the State and perused the record. The instant Criminal Revision has been moved on behalf of the revisionist, Buddhi Sagar Shukla under Section 401 read with Section 397 Cr.P.C. against the order dated 03.08.2023 passed by learned Additional Sessions Judge, Court No.5, Lucknow in Criminal Appeal No.189 of 2023, whereby the revisionist has been directed to deposit 50 % of the fine imposed by the learned trial court. At the very outset, learned counsel for the revisionist confined his prayer to the extent that the revisionist is ready to deposit the entire amount i.e. 50 % of the fine as imposed by the learned trial court, however, some time may be extended by this Hon'ble Court in the interest of justice as the revisionist is a very poor person. Learned A.G.A. for the State has no objection to the request made by learned counsel for the revisionist as the direction will be in the interest of justice, however, he submits that only two months' further time may be given to the revisionist. In view of above, the instant Criminal Revision is disposed of with a direction to the revisionist to deposit the entire amount i.e. 50 % of the fine as imposed by the learned court below vide order dated 03.08.2023 within two months from today without fail.
