Submission of learned counsel for the petitioner is that one Guddu, a member of the Gram Sabha, has been authorized to discharge the duties of the Gram Pradhan after the death of Gram Pradhan by means of the proposal dated 19.10.2023 against the provisions made in 12(j) of the U.P. Panchayat Raj Act, 1947. Learned Additional Chief Standing Counsel, on the basis of instructions, submits that the District Magistrate has approved the proposal on 27.10.2023. Accordingly, an order has been passed by the District Panchahat Raj Officer on 28.10.2023. A copy of which has been provided to the learned counsel for the petitioner. Learned counsel for the petitioner submits that this petition may be dismissed as not pressed with liberty to avail the appropriate remedy as may be available. To which there is no objection by the other side.
