¶1Heard learned counsel for the petitioner, leaned State counsel for opposite parties No.1 to 3 and Mr. R.K. Upadhyaya learned counsel for opposite party No.4.

¶2On 05.10.2023, the following order had been passed:- "1. Heard learned counsel for petitioner and learned State Counsel for opposite parties 1 to 3 and Mr. R.K.Upadhyaya, learned counsel for opposite party no.4.

¶2Petition has been filed challenging order dated 08.06.2023 whereby offer of appointment to petitioner has been cancelled.

¶3It has been submitted that impugned order has been passed only on ground that petitioner was duly selected and issued appointment letter on 01.10.2020 on the post of Ayurvedic Medical Officer but failed to join his post within the prescribed time.

¶4Learned counsel for petitioner however has drawn attention to letters dated 26.10.2020 and 12.07.2023 issued by Regional Ayurvedic & Unani Officer Maharajganj to substantiate that in fact in pursuance of petitioner's appointment, he had already given his joining on 26.10.2020 itself, which was within one month from the date of issue of appointment letter and therefore the grounds indicated in impugned orders are baseless.

¶5Learned counsel for opposite parties are granted ten days' time to seek instructions with regard to aforesaid submissions.

¶6List this case on 16.10.2023, as fresh."

¶3In pursuance thereof, written instructions dated 31.10.2023 have been provided to petitioner issued by the Director, Ayurveda Services Lucknow, which is taken on record and as per which the impugned order dated 08.06.2023 has been cancelled. In pursuance thereof, the petitioner has already been provided joining on the post of Medical Officer, Ayurveda in the Rajkiya Ayurvedic Chikitsalya, Baithvaliya District Maharajganj.

¶4In view of aforesaid, nothing more requires to be adjudicated upon in the present petition and is accordingly consigned to record without interfering in the benefits granted to the petitioner.
