Heard learned counsel for the petitioner, Shri Anurag Tripathi, learned counsel for the respondent no. 1 and Shri Samanvaya Dhar Dwivedi, learned counsel for the respondent no. 3. With the consent of learned counsel appearing for the contesting parties, the writ petition is being finally decided. The instant writ petition has been filed praying for the following main reliefs: "1. Issue a writ, order, or direction in the nature of Mandamus commanding the opposite party No-2 i.e. Managing Director UP Bhumi Sudhar Nigam Lucknow to pay deference of arrears of salary in sixth pay scale of Rs31,236/- & balance gratuity of Rs 67,316/- along with admissible interest to the petitioner within stipulated period, in the interest of justice.

¶2Issue a writ or order in the nature of Mandamus commanding the opposite party No-2 i.e. Managing Director U.P. Bhumi Sudhar Nigam Lucknow to consider and decide the representation of petitioner for payment of deference of arrears of salary as well as balance gratuity and pay the same alongwith admissible interest within stipulated period, in the interest of justice." The contention of learned counsel for the petitioner is that for the claims, the petitioners have moved a representation before the respondent No.2. Considering the fact that the petitioners have already represented the matter, the present petition is disposed of permitting the petitioners to file a fresh representation before the respondent No.2 who is directed to pass an order in accordance with law within a period of six weeks. In case the petitioners are found to be entitled for any benefits, the same shall be extended and paid to the petitioners within a further period of three months. Order Date :- 2.11.2023 J.K.
