Judgment

Court No. - 1 Case :- PUBLIC INTEREST LITIGATION (PIL) No. - 1013 of 2023 Petitioner :- Subhash Dixit Respondent :- State Of U.P. Thru. Prin. Secy. Food And Civil Supplies Civil Secrt. Lko. And Others Counsel for Petitioner :- Rama Kant Dixit Counsel for Respondent :- C.S.C.,Pramod Singh Hon'ble Attau Rahman Masoodi,J. Hon'ble Om Prakash Shukla,J.

¶1Heard Sri Pratyush Chaubey, learned Standing Counsel for the State and Sri Pramod Singh, learned counsel who has filed vakalatnama on behalf of respondent no.8.

¶2Sri Pramod Singh, learned counsel has stated that the opposite party no.8 shall ensure timely payment to the agriculturists on procurement of paddy at the purchase centres and there is no complaint in this regard raised in the writ petition whatsoever.

¶3This writ petition filed in 'public interest' has raised a grievance against the notification of some more agencies for the purposes of purchase of paddy at the purchase centres. It is not the case before us that the agriculturists from whom the paddy is purchased are not paid the price of agricultural produce directly in their accounts or there is any delay in this regard. The additional purchase agencies to our understanding shall expedite the process of purchase so as to optimize the procurement of paddy from the farmers and such a measure cannot be doubted or understood to be detrimental to the public interest.

¶4In absence of any grievance regarding payment of the price against the supply of agricultural produce, it is difÏcult for us to appreciate the grievance on a hypothetical basis.

¶5The writ petition does not espouse any cause warranting interference by this Court in public interest.

¶6The Writ petition being bereft of any merit is accordingly dismissed. Order Date :- 2.11.2023/Shahnaz High Court of Judicature at Allahabad, Lucknow Bench
