¶3The aforesaid case has been registered on the basis of an F.I.R. lodged on
08.03.2023 against three persons, not including the applicant, alleging that accused persons had indulged in brick batting with the informant's son and co-accused Mangal fired a shot with a country made pistol due to which the informant's son suffered an injury on his left thigh.
¶4The medico legal examination report mentions a solitary lacerated wound on his left thigh. The applicant's name was added in the informant's statement recorded under Section 161 Cr.P.C
¶5In the affidavit filed in support of bail application it has been stated that the applicant is innocent and he has been falsely implicated in the present case. The applicant's involvement in another case bearing Case Crime No. 44/2023 under Section 302/504/506 I.P.C., registered at Police Station Bihar, District Unnao, has been disclosed in para 10 of the affidavit, which F.I.R was lodged on

¶7The learned A.G.A. has opposed the prayer for bail but he could not dispute the aforesaid aspects of the matter.
¶8Having considered the aforesaid facts and circumstances of the case and keeping in view the fact that the applicant is not named in the F.I.R and the informant has implicated him in a subsequent statement; that a co-accused person, who is named in the F.I.R has been granted bail, coupled with the fact that applicant is languishing in jail since 12.3.2023 and without making any observation, which may affect the merits of the case, I am of the view that the aforesaid facts are sufficient for making out a case for enlargement of the applicant on bail in the aforesaid crime.
¶9Accordingly, this bail application stands allowed.
¶10Let the applicant-Buddh Deo @ Shiv Baran be released on bail in the aforesaid case, on furnishing a personal bond and two sureties each in the like amount to the satisfaction of magistrate/court concerned, subject to following conditions:-
