¶7Having considered the aforesaid facts and circumstances of the case and keeping in view the fact that even as per the F.I.R averments, no robbery took place against the informant; that the applicant has been implicated in the present case solely on the basis of his custodial statement and no objectionable article has been recovered from the applicant; that the applicant has allegedly been identified by the informant while he was in custody and no identification parade has been carried out in accordance with the manner prescribed by Section 54 A Cr.P.C, coupled with the fact that the applicant has no previous criminal history and he is languishing in jail since 09.07.2023 and without making any observations which may affect the merits of the case, I am of the view that the aforesaid facts are sufficient for making out a case for enlargement of the applicant on bail.
