¶1Heard learned counsel for the revisionist and learned AGA for the State.

¶2Instant criminal revision under Section 397 read with Section 401 of Cr.P.C. is preferred against the judgment and order dated

04.10.2023 passed by the Court of Special Judge, Gangster Act/ADJ, Lucknow in Criminal Case No. 32 of 1993 under Section 2/3 U.P. Gangsters Act, Police Station-Ghazipur, District-Lucknow thereby closing the opportunity of evidence of accused.

¶3It is submitted that case is an old one of year 1993 and prosecution has been given 31 years for evidence and due to strike in relation to Hapur incident, revisionist could not procure the certified copy of the judgment which were to be filed as defence evidence. It is submitted that revisionist should be given an opportunity to file those evidences.

¶4From the perusal of the record, it transpires that case is an old one and court below must be in a pressure to decide the case, however, reasonable opportunity should be given to the revisionist to adduce defence evidence also.

¶5In the circumstances as above, the instant revision is finally disposed of with a direction to the revisionist to produce all the certified copy of the relevant judgments along with affidavit within 15 days from today.
