¶1Heard learned counsel for petitioner, learned Standing Counsel for the State and Sri S.B. Pandey, learned Senior Advocate assisted by Sri Varun Pandey, appearing on behalf of respondent no.2-U.P. Expressways Industrial Development Authority, Ganga Expressway.

¶2Petitioner has approached this Court claiming that respondents are illegally taking possession of land bearing Gata no.398, area 0.4020 hectare situated at village Malikapur, Pargana Pachhoha, Tehsil Sawayajpur, District Hardoi.

¶3Sri S.B. Pandey, learned Senior Advocate appearing for respondent no.2, on written instructions, states as follows: "्ቚकरण मम ररामवविलरास पपु्ቔ ररामभररोससे वनिविराससी गराम ककी भभूवम गराटरा ससं० 398/0.1500 मम 1/2 भराग कसे्ቔफल 0.0750 कसे भपुगतरानि कसे सम्बन्ध मम कराररविराहसी कर दसी गई हहै तथरा गराटरा ससंख्ररा 398/0.2520 कसे 1/2 भराग

0.1260 हसे० कसे ्ቅ र वकरसे जरानिसे कसे सम्बन्ध मम कराररविराहसी ककी जरा रहसी हहै। शसेष खरातसेदरार गगौतम निराबरा उ्቞ 13 विषर पपु्ቔ रराम्ቚसराद, कपु० गरार्ቔसी दसेविसी निराबरा उ्቞ 15 विषर पपु्ቔसी रराम्ቚसराद, कपु० जभूलसी निराबरा उ्቞ 8 विषर पपु्ቔसी रराम्ቚसराद ससंरकक न्रराररालर तर" कसे सम्बन्ध मम सकम न्रराररालर दराररा ससंरकक कसे सम्बन्ध मम आदसेश पराररत हरोनिसे कसे उपररान्त बहैनिरामरा कररारसे जरानिसे ककी कराररविराहसी पभूणर कर दसी जरारसेगसी। आख्ररा सरादर ्ቚसेवषत हहै।"

¶4Thus, it is already provided by respondents that sale deed would be executed as soon as petitioner approaches the authority concerned along with guardianship certificate. The said statement is taken on record.

¶5The payments in reference of Ram Vilas son of Ram Bharose for Gata no.398/0.1500 i.e. 0.0750 hectare shall be made expeditiously; the proceedings for purchase of half portion of Gata no.389/0.2520 i.e. 0.1260 hectare shall also be completed expeditiously and the proceedings for the portion for which, petitioner/appropriate person is required to take guardianship certificate, shall also be completed expeditiously after the aforesaid formalities are completed.
