On an objection raised by learned Standing Counsel that this petition with a prayer for direction to the opposite party to decide the proceedings pending before the prescribed authority insituted on a show cause notice issued by him is not maintainable under Article 227 of the Constitution of India, Ms. Yashi Mishra, learned counsel for the petitioner submits that the petition may be dismissed as not pressed with liberty to avail the appropriate remedy/file fresh petition under correct provision as may be available under law. He further prays that the certified copy/copies annexed with this petition may be directed to be returned to learned counsel for the petitioner. In view of above, the petition is dismissed as not pressed with liberty as aforesaid. Office is directed to return the certified copy/copies annexed with this petition to learned counsel for the petitioner, after keeping the photocopy of the same on record, in accordance with law.
