Court No. - 18 Case :- MATTERS UNDER ARTICLE 227 No. - 5631 of 2023 Petitioner :- Ramdev Yadav Respondent :- Addl. Commissioner, Ayodhya Division, Ayodhya And Others Counsel for Petitioner :- Naveen Shukla,Jayshanker Shukla,Shubham Srivastava Counsel for Respondent :- C.S.C.,Mohan Singh Hon'ble Saurabh Lavania,J. Heard. In view of order proposed to be passed, issuance of notice to the private-respondent(s) is hereby dispensed with. The present petition has been filed for the following main relief:- "(i) issue a order or direction to the opposite party No. 1 to decide the revision u/s 210, No. 1676 of 2023, Ram Dev Vs. Shehnaj Begum and Others pending before Additional Commissioner (Judicial), Ayodhya Division since 12.07.2023, expeditiously within the stipulated time as this Hon'ble Court deem just and proper." On being confronted on the main relief sought, quoted above, at early stage, learned Counsel for the petitioner says that justice would suffice if a direction is issued to the respondent no.1 i.e. Additional Commissioner (Judicial), Ayodhya Division, Ayodhya, to consider and decide the pending application seeking interim protection, within time specified by this Court. To the aforesaid prayer, there is no objection. Considering the facts and circumstances of the case, this Court is of the view that no fruitful purpose will be served in keeping this petition pending. Accordingly, this petition is disposed of with a direction to the respondent No.1 to consider and decide the pending application seeking interim protection most expeditiously after affording full opportunity of hearing to the parties to the litigation and without granting any adjournment to either party preferably within a period of three months from the next date fixed in the case, if possible and if there is no other legal impediment in this regard. Liberty is also given to the petitioner to approach this Court for expeditious disposal of revision, at appropriate stage. It is made clear that the Court has not examined the case of either party on merits and the Authority concerned shall be free to decide the matter strictly in accordance with law. With the aforesaid, the petition is disposed of. Order Date :- 3.11.2023 Jyoti/- High Court of Judicature at Allahabad, Lucknow Bench
