Judgment
Court No. - 3 Case :- WRIT - C No. - 9174 of 2023 Petitioner :- Rekha Respondent :- State Of U.P. Thru. Chief Secy. Govt. Lko And 3 Others Counsel for Petitioner :- Sushil Kumar Verma,Abhishek Singh,Viksit Srivastava Counsel for Respondent :- C.S.C.,Aprajita Bansal Hon'ble Vivek Chaudhary,J. Hon'ble Manish Kumar,J. Personal affidavit filed on behalf of Opposite Parties Nos. 2 to 4 is taken on record. Heard learned counsel for the petitioner and Ms. Aprajita Bansal, learned counsel for the respondents. The petitioner, who is a poor farmer asked for a load of 1 KW for small house of 600 sq. ft. in Village - Bhaptamau, Ward - Haiderganj, District Lucknow, for which an assessment of Rs.41,000/- was raised against the her. Admittedly, the village is already under the electrification but some part of the village appears to be falling beyond the line already drawn by the respondent - department. The Central Government as well as the State Government has already initiated scheme for rural electrification. Purpose of the said scheme is that every house in the country should have electricity connection. The said scheme would fail on its face if more than forty thousand rupees is asked from poor villagers for providing small electricity connection which is hardly sufficient to their house. In the aforesaid circumstances, it is provided that the Respondent No.3 the Executive Engineer, M.V.N.L. Indralok Hydel Colony, Lucknow Uttar Pradesh shall provide electricity connection to the petitioner on payment of Rs.5000/- only as a charges for the same. The remaining amount can be charged by the corporation on its Budget for spreading the villages electrification. The writ petition is allowed. .
