Court No. - 10 Case :- CRIMINAL MISC. WRIT PETITION No. - 8495 of 2023 Petitioner :- Poonam And Another Respondent :- State Of U.P. Thru. Secy. Home Deptt. U.P. Lko. And Others Counsel for Petitioner :- Bhanu Pratap Mishra Counsel for Respondent :- G.A. Hon'ble Mrs. Sangeeta Chandra,J. Hon'ble Narendra Kumar Johari,J.
(1) Heard the learned counsel for the petitioners and the learned A.G.A. who appears for the Opposite party nos.1, 2 & 3.
(2) This petition has been filed by the petitioners for the following main prayer:- "1) Issue a writ, order or direction in the nature of Mandamus thereby commanding and directing the Opposite parties specially Opposite party nos.3 and 4 not to harass the petitioners and the family members of the Petitioner no.2 in any manner, in the interest of justice."
(3) It has been submitted by the learned counsel for the petitioners that the Petitioner no.1-Poonam, is an unmarried girl of 19 years. Her date of birth is 01.01.2004. The sister of the Petitioner no.1 namely Sanno, is married to the Petitioner no.2, both are residing in Jalandhar. The Petitioner no.1 wanted to pursue her study but her father, Opposite party no.4 was insisting her to marry to a person of his own choice. The petitioner no.1 ran away to her sister's house some four months ago and has been living there. The father of the Petitioner no.1 has approached the Police Personnel of Police Station Fursatganj, District Amethi, and now the Police personnel of Police Station Fursatganj, District Amethi, are harassing the Petitioners who are living in Jalandhar. The entire story as has been stated in the writ petition, appears to be improbable as without there being any F.I.R. lodged by any person, there is no occasion for the the Police Personnel of the Police Station Fursatganj District Amethi, to visit Jalandhar and to harass the petitioners and her sister and her husband.
(4) This Court has perused the F.I.R. and finds that there is no good ground to interference in the matter.
(5) The writ petition stands dismissed. Order Date :- 3.11.2023 N.PAL High Court of Judicature at Allahabad, Lucknow Bench
