Court No. - 18 Case :- MATTERS UNDER ARTICLE 227 No. - 617 of 2022 Petitioner :- Malti Devi Respondent :- Parmatma And 4 Others Counsel for Petitioner :- Saima Khan Counsel for Respondent :- C.S.C. Hon'ble Saurabh Lavania,J. Heard. In view of the order proposed to be passed by this Court, notice to the private-respondent(s) is dispensed with. By means of the instant petition, the petitioner seeks expeditious disposal of Revision No.1405 of 2016 filed under Section 210 of U.P. Land Revenue Act, 1901 pending before the respondent No.5. It is stated that as per Rule 183(4) of the U.P. Revenue Code Rules, 2016 read with Para 458(2) of U.P. Revenue Court Manual, a revision or appeal should be decided preferably within a period of six months. However, in the instant case, the revision is pending since 2016. Prayer is to direct the respondent No.2 to decide the revision within stipulated time. Learned standing counsel submits that he has no objection in case an expedite order is passed. Considering the facts and circumstances of the case, this Court is of the view that no fruitful purpose will be served in keeping this petition pending. Accordingly, this petition is disposed of with a direction to the respondent No.5-Board of Revenue, Lucknow, U.P. to consider and decide the Revision No.1405 of 2016, most expeditiously after affording full opportunity of hearing to the parties to the litigation and without granting any unnecessary adjournment to either party preferably within a period of six months from the next date fixed in the case, if possible and if there is no other legal impediment in this regard. It is made clear that the Court has not examined the case of either of the parties on merits and the authority concerned shall be free to decide the matter strictly in accordance with law. With the aforesaid, the petition is disposed of. Order Date :- 3.11.2023 Vinay/- High Court of Judicature at Allahabad, Lucknow Bench
