¶1Heard learned counsel for the petitioner and Sri S.S. Rajawat, learned counsel for opposite party no.2.

¶2Sri S.S. Rajawat has stated that the order of the writ court dated 30.01.2023 passed in Writ-A No.798 of 2023 has been complied with as claim of the petitioner for payment of gratuity has been considered and decision has been taken for payment of gratuity to the petitioner. Further, the amount of gratuity shall be paid to the petitioner as early as possible.

¶3Be that as it may, when the appropriate decision has been taken to make payment of gratuity to the petitioner, then the same must be paid to the petitioner with expedition. It is expected that the petitioner shall be paid the amount of gratuity within a period of three weeks from today, to be more precise on or before 02.12.2023 and that amount shall be credited in the account of the petitioner, failing which liberty is given to the petitioner to file an appropriate application in the present contempt petition for seeking revival of the same. In case it is found that the amount of gratuity has not been paid to the petitioner on or before the stipulated time and if the contempt petition is revived, any coercive order may be passed against the erring opposite parties under the Contempt of Courts Act.

¶4Accordingly, the present contempt petition is dismissed.
