¶1Heard learned counsel for petitioner and learned State Counsel appearing on behalf of opposite parties.
¶2Petition has been filed seeking a direction to opposite parties to consider petitioner's claim for regularization on a Class IV post from the date persons junior to petitioner have been regularized. Further prayer for creation of supernumerary post in case petitioner is found eligible for regularization has also been sought alongwith relief or minimum of pay-scale. It is submitted that petitioner has been engaged as a daily wage worker on a class IV post in October, 2001 and is therefore covered under the relevant rules.
¶3For the aforesaid grievance, petitioner has already submitted a representation but seeks liberty to file a fresh representation before authority concerned. At present learned counsel for petitioner restricts his prayer for a final decision with regard to same.
¶4Considering innocuous prayer being made by learned counsel for petitioner and without entering into the merits of the case petitioner is granted liberty to file a fresh representation before opposite party No.4 i.e. Divisional Forest Officer, Gonda Division, Gonda. In case such a representation is filed, the same shall be considered and decided by a reasoned and speaking order within a period of eight weeks from the date a certified copy of this order is produced before the said authority.
¶5With the aforesaid observation, petition stands disposed of. Order Date :- 6.11.2023 Subodh/- High Court of Judicature at Allahabad, Lucknow Bench
