¶1Heard learned counsel for petitioner, Mohd. Ahsanussamad Faridi, learned counsel for respondent nos.2 and 3 and learned standing counsel for State.

¶2Present petition is filed by the petitioner with the following prayers:- "i. issue a writ, order or direction in the nature of Mandamous commanding the opposite parties to no. 2 to pay all dues of the petitioner amounting Rs.13,44,756.22 (Rupees thirteen Lakh fourty four thousand seven hundred fifty six and twenty two Paise) within stipulated time. ii. issue a writ, order or direction in the nature of Mandamus commanding the opposite party No.2 to consider the representation dated 07-10-2023 with reasoned and speaking order within stipulated time. "

¶3Learned counsel for petitioner submits that grievance of petitioner would sufficiently be met in case representation of petitioner for the said purposes is considered and decided in a time bound manner.

¶4Learned standing counsel and learned counsel for respondent nos.2 & 3 have no objection to the same.

¶5In view thereof, petitioner is permitted to make a fresh detailed representation to respondent no.2-Executive Officer, Nagar Panchayat, Asharafpur Kichhauchha, District-Ambedkar nagar, raising all his grievance, annexing therewith a copy of this writ petition along with annexures and all the documents in support of his claim within a period of two weeks from today along with a certified copy of this order.

¶6In case such a representation is moved by petitioner, respondent no.2 shall consider and decide the same in accordance with law by a reasoned and speaking order within a period of three months from the date a certified copy of this order along with representation is placed before him.

¶7It is made clear that this court has not applied itself on the merits of the case and all questions are left open to be considered and decided by the competent authority in accordance with law.
