¶1Heard learned counsel for petitioner and learned State Counsel appearing on behalf of opposite parties.

¶2Petition has been filed challenging order dated 13.09.2023 whereby petitioner's claim for consequential service benefits such as restoration of increments, arrears of salary, pay fixation and promotion etc has been rejected.

¶3Learned counsel for petitioner on the basis of instructions however submits that he may be granted liberty to withdraw this petition in order to enable him to avail an alternative remedy of filing of claim petition before the State Public Services Tribunal.

¶4Considering the aforesaid submission, petition is dismissed as withdrawn granting liberty to petitioner to approach the U.P. State Public Services Tribunal. In case such claim petition is filed, the same shall be considered and decided expeditiously without granting undue adjournments.
