¶1Heard Sri Amit Kumar, the learned counsel for the applicant as well as Sri Rakesh Kumar Singh, the learned learned Additional Government Advocate-I appearing on behalf of the State and perused the records.
¶2The instant application has been filed by the applicant seeking anticipatory bail in F.I.R. bearing Case Crime No. 1261/2010, under Sections 419/ 420/ 467/ 468/ 471 IPC, Police Station Auras, District Unnao.
¶3The aforesaid case has been registered on the basis of an F.I.R. lodged on 04.08.2010 alleging that under pretext of getting old age pension to the informant, the applicant got a sale deed executed by him.
¶4The learned AGA has raised a preliminary objection that the FIR in question was lodged on 04.08.2010 and the summoning order was passed by the trial court on 15.03.2011. The applicant has approached this Court seeking anticipatory bail in 2023, without any explanation for the delay.
¶5Having considered the aforesaid facts and circumstances of the case, I am of the view that the applicant does not deserve to be granted discretion of this court by granting pre-arrest bail to him.
¶6The anticipatory bail application is rejected accordingly. However, in case the applicant files an application for grant of bail, the same shall be considered and decided on its merits, without being influenced by any observations made in this order.
