¶1Heard learned counsel for the petitioner, Shri Ashok Kumar Verma, learned counsel for the respondent No.4-U.P. Pollution Control Board and learned Standing Counsel for State-respondents.

¶2The present writ petition filed by the petitioner-Vinod Kumar Yadav, seeks to raise a grievance for protection of his rights against the noise and air pollution spread by running a rice and flour mill by the respondent No.4 with the aid of tractor engine.

¶3This is purely a question of fact which can be looked into by the local authorities.

¶4Shri A.K. Verma, learned counsel for the U.P. Pollution Controal Board, has also clarified that insofar as small-scale industries are concerned, any such issue or grievance is to be looked into by the local authorities.

¶5Thus, it is left open to the petitioner to make an appropriate application before the competent local authority with a copy endorsed to the Pollution Control Board as well so that necessary action is taken by the authorities concerned so as to redress the grievance of the petitioner, if any.
