¶1Heard learned counsel for petitioners and learned Standing Counsel for the State.

¶2Petitioners have approached this Court for quashing of the Government Order dated 23.8.2017 as well as for a mandamus commanding the respondents to exclude 358 reserved items from MSEs of the State of U.P. from the GeM portal of the State and purchase the 358 reserved items/stores through State Purchase Organization ensuring the rate contract system and following the price preference system, with a further prayer to direct respondent no.4 to conclude award of Government evaluated rates in terms of gazette notified rate contract of due and pending stores.

¶3After arguing at some length, learned counsel for petitioners submits that grievance of petitioners would be sufficiently met in case representation of petitioners for the said purposes is considered and decided by respondent no.4 in a time bound manner.

¶4Learned Standing Counsel has no objection to the same.

¶5In view thereof, petitioners are permitted to make a fresh detailed representation to respondent no.4-Commissioner and Director Industries, U.P., G.T. Road, Sarvoday Nagar, Kanpur, raising all their grievance, annexing therewith a copy of this writ petition along with annexures and all the documents in support of their claim within a period of two weeks from today along with a certified copy of this order.

¶6In case such a representation is moved by petitioners, respondent no.4 shall consider and decide the same in accordance with law after hearing the representatives of petitioner, by a reasoned and speaking order within a period of three months from the date, a certified copy of this order along with representation is placed before him.

¶7It is made clear that this court has not applied itself on the merits of the case and all questions are left open to be considered and decided by the competent authority in accordance with law.
