The application of the petitioner filed under Section 239 IPC has been rejected by the Civil Judge, FTC-Naveen, Gonda vide order dated

कलपकश हल। Perusal of the impugned order shows that initially an FIR was lodged under Section 420/304/201/328 IPC, P.S. Chapiya, District Gonda against the number of accused persons, however, after conducting investigation, charge sheet has been filed only against the petitioner under Section 420 IPC. Presently the case is fixed for appearance of the accused. The trial is pending since 2012. It is an old trial. Defence of the petitioner that the complainant Mohani Devi after being annoyed has filed false case regarding execution of the will deed is subject matter of evidence as has been rightly held by the trial court.
