Counsel for Respondent :- Y.K.Misra,Sameer Kalia Hon'ble Attau Rahman Masoodi,J. Hon'ble Om Prakash Shukla,J.

¶1Heard learned counsel for the parties.

¶2This intra-court appeal filed under Chapter VIII Rule 5 of the Allahabad High Court Rules, 1952 has assailed the judgement/order dated 09.02.2004 rendered in two writ petitions namely W.P.No.2054 (S/S) of 2000 (Committee of Management, Anand Singh Intermediate College, Rai Askaranpur, Distt. Pratapgarh vs. State of U.P & Ors.) and W.P.No.1406 (S/S of 2001 (Anant Prasad Tiwari & Ors. vs. State of U.P. & Ors.). Both the writ petitions involving the same issue were decided by a common judgement rendered on 09.02.2004.

¶3The State has preferred a special appeal against the judgement rendered in the writ petition filed by the Committee of Management, whereas, no challenge has been made to the same judgement insofar as the teachers of the institution who had instituted W.P.No.1406 (S/S of 2001 are concerned.

¶4Today, when the case was taken up, it is informed that the judgement passed on 09.02.2004 in the aforementioned writ petitions had already been complied with and the special appeal impleading the Committee of Management has virtually been rendered infructuous.

¶5The special appeals thus having been rendered infructuous is accordingly consigned to record. .Order Date :- 6.11.2023/Shahnaz High Court of Judicature at Allahabad, Lucknow Bench
