¶1Heard learned counsel for the petitioner, Sri Shikhar Anand learned counsel for respondent no.1 and Sri Ran Vijay Singh, learned counsel for respondent no.3.

¶2The impugned order of penalty is stayed subject to the petitioner's filing an application for recall of the order before the Information Commissioner under Rule 12 of the U.P. Right to Information Rules, 2015.

¶3In case any such application is filed within two weeks, the same shall be considered by the Information Commissioner within a period of two months from the date of its filing.

¶4For a period of four months, the recovery proceedings shall remain stayed and the same shall abide by the outcome of the recall application.
