By means of the present petition, the petitioner has assailed the order dated 17.10.2023, whereby the Civil Judge (S.D.), Mohanlalganj, District - Lucknow rejected the application 6ga under Order 39 Rule 1 & 2 CPC preferred by the petitioner in Civil Suit No. 829/2023. In view of the remedy of appeal provided under Order 43 Rule 1 CPC, this Court is of the opinion that the present petition is not maintainable. Accordingly, the present petition is dismissed with the liberty to the petitioner to avail the remedy as indicated under Order 43 Rule 1 CPC..
