Present petition has been filed for the following main relief:- "(i) To issue a writ, order or direction in the nature of cerciorary quashing the impugned order dated-10.01.2023 passed by learned civil judge (S/D) Gonda (Ram Ajor and ors versus State of U.P and others) contants as annexure Oath Commissioner no.1 to this writ petition.

(ii) To issue a writ, order or direction in the nature of mandamus commanding and directing to the learned District judge Gonda to decide the appeal no.4/2023 (Ram Ajor and ors versus State of U.P and others) within stipulated period.

(iii) To issue getCommissioner writ, order or direction in the nature of mandamus commanding and directing to the respondents /authorities not make any construction upon the land disputed(Gata no.2690 Ka & Gha) situated in village Ghari ghat, Pargana-Budhapayar, Tahsil-Mankapur, District-Gonda, during the pendency of present writ petition." Taking note of the prayers sought in the present petition as also the fact that presently Court concerned is vacant and on being confronted to the same, learned counsel for the petitioners says that he may be permitted to withdraw present petition with liberty to file fresh. To the aforesaid prayer, learned counsel for the State has no objection. In view of aforesaid, present petition is dismissed as withdrawn with aforesaid liberty. The Office/Registry is directed to return the certified copy of the documents annexed with the petition, if any, to the learned counsel for the petitioners, as per Rules of the Court.
