Heard learned counsel for petitioner and learned State Counsel appearing on behalf of opposite parties. Petition has been filed challenging order dated 26th May, 2023 whereby petitioner working on the post of Head Constable has been transferred from Commissionerate Agra to Ghaziabad. It has been submitted that while passing the impugned order, opposite parties have not taken into account the fact that petitioner's wife is also in government service in Agra and therefore petitioner's case would be covered under paragraph 5 of the government order dated 7th June, 2023. Grounds of ailment of his wife and mother have also been taken. It is submitted that petitioner has not yet been relieved from Agra and his representation for the said grievances may be considered. For the aforesaid grievance, the petitioner has already submitted a representation dated 19th October, 2023. At present learned counsel for the petitioner restricts his prayer for a final decision with regard to same. Considering innocuous prayer being made by learned counsel for the petitioner and without entering into the merits of the case petitioner is granted liberty to file a fresh representation before opposite party No. 4 i.e. Additional Superintendent of Police, through Deputy Inspector General of Police, Karmik, U.P., Lucknow within a period of three days from today. In case such a representation is filed, the same shall be decided by a reasoned and speaking order within with period of ten days from the date a copy of this order is produced before the said authority in the light of provisions of government order dated 7th June, 2023. In case petitioner has yet not been relieved from Agra, he shall not be compelled to join at the transferred place till final decision on his representation.
