Judgment

Court No. - 18 Case :- MATTERS UNDER ARTICLE 227 No. - 5770 of 2023 Petitioner :- Mrs. Asha Pandey Respondent :- Board Of Revenue Lko Thru. Chairman And 4 Others Counsel for Petitioner :- Gaurav Kumar Hasani Counsel for Respondent :- C.S.C. Hon'ble Saurabh Lavania,J. Heard. In view of order proposed to be passed, issuance of notice to the private-respondents is hereby dispensed with. The present petition has been filed for the following main relief:- "To issue order or direction there by commanding and directing the respondent no. 1 to decide the (Revision No. 2399 of 2009-10 pending Smt. Chitra Rekha Pandey V/S Kailash Nath and others Under section 219 of U.P. Land Revenue Act) (Annexure No.1) before Board of Revenue Lucknow expeditiously within the stipulated period." From the records it is apparent that revision in issue was admitted on

18.05.2010 and the same is pending till date and according to 458(2) of U.P. Revenue Court Manual, an appeal or revision should preferably be decided within a period of six months and as such this Court is of the view that justice would suffice, if a direction is issued to opposite party no.1/Board of Revenue, Lucknow, to decide the pending revision in issue, at the earliest. Accordingly the present petition is disposed of with direction to respondent no.1, to consider and decide the Revision No. 2399 of 2009-10 (Smt. Chitra Rekha Pandey V/S Kailash Nath and others) most expeditiously, after affording full opportunity of hearing to the parties, but without granting any unnecessary adjournment, preferably within a period of four months from the next date fixed before it, if there is no other legal impediment in this regard. It is made clear that the Court has not examined the case of either of the parties on merits and the authority concerned shall be free to decide the matter strictly in accordance with law. With the aforesaid, the petition is disposed of. Order Date :- 8.11.2023 Jyoti/- High Court of Judicature at Allahabad, Lucknow Bench
